Chapter 13 offers some options that are not available in Chapter 7. For example, Chapter 13 offers the opportunity to save your home from foreclosure. A Chapter 13 case can stop foreclosure proceedings and can assist you in bringing your delinquent mortgage payments current by allowing you to pay the delinquent amount over a period of years. In addition, the Court allows you to make payments to your creditors based upon what you can afford, not what you owe. Once you make all of your monthly payments to the Court in your payment plan, whatever amounts remain due after you complete the plan may be forgiven or discharged.
